BORO DENIM offers for sale clothing and products presented on the site, within the limits of available stock.
Photographs, colors, and descriptions are presented with the utmost care. Slight variations may exist depending on screens, dye baths, washes, materials, or finishes.
2. Orders
Any order placed on the site implies acceptance of these General Terms and Conditions of Sale.
KODAWARI FAMILY may refuse or cancel an order in case of refused payment, suspicion of fraud, obvious pricing error, out-of-stock items, prior dispute, or incomplete customer information.
After validating the order, the customer receives a confirmation email.
3. Price and payment
Prices are indicated in euros, all taxes included for sales applicable in France and the European Union, unless otherwise stated.
Delivery costs, import taxes, customs duties, or any banking fees are indicated or remain the responsibility of the customer depending on the delivery country.
Payment is due at the time of order. The order is processed only after effective payment validation.
4. Delivery
Products are delivered to the address indicated by the customer when ordering.
Delivery times are given for information only. KODAWARI FAMILY cannot be held responsible for a delay related to the carrier, customs, an incorrect address, or an external event.
For deliveries outside the European Union, customs duties, taxes, or import fees may be due by the customer upon receipt. These fees are not included in the price paid on the site, unless otherwise stated.
5. Receipt
The customer must check the condition of the package and products upon receipt.
Any visible anomaly, missing product, reference error, or apparent damage must be reported by email to hello@boro-denim.com within 7 calendar days after receipt, with photos and order number.
6. Right of withdrawal
For consumer customers located in the European Union, the customer has a legal period of 14 days from receipt of the order to exercise their right of withdrawal, without having to justify their decision.
To exercise this right, the customer must contact hello@boro-denim.com, indicating their order number.
Products must be returned in their original condition, unworn, unwashed, unaltered, with their original tags and packaging.
Return shipping costs are the responsibility of the customer, except for KODAWARI FAMILY error or defective product.
7. Returns and refunds
No returns will be accepted without prior request to KODAWARI FAMILY.
After receipt and inspection of the returned products, the refund will be made to the original payment method, within the applicable legal deadlines.
KODAWARI FAMILY may refuse to refund a returned product that has been worn, washed, stained, altered, damaged, incomplete, or without its original tag.
Initial delivery costs may be refunded within the limits provided by law. Additional costs related to an express or premium delivery method chosen by the customer are not refunded.
8. Exchanges
Exchanges are accepted subject to product availability and prior validation by KODAWARI FAMILY.
If the product requested for exchange is not available, a refund or credit note may be offered depending on the applicable case.
9. Legal guarantees
Products benefit from applicable legal guarantees, notably the legal guarantee of conformity and the guarantee against hidden defects.
These guarantees do not cover normal wear and tear, improper maintenance, washing not in accordance with instructions, abnormal use, alteration, or damage caused by the customer.
10. Intellectual property
The BORO DENIM brand, texts, images, photographs, videos, creations, graphics, logos, and elements of the site are protected by intellectual property rights.
Any unauthorized reproduction, use, or exploitation is prohibited.
11. Personal data
Personal data collected during the order is processed in accordance with the Privacy Policy available on the site.
12. Force majeure
KODAWARI FAMILY cannot be held responsible for a delay or non-performance resulting from an external event, unforeseeable, or reasonably beyond its control, including transport, customs, strike, health crisis, natural disaster, conflict, administrative restriction, or major technical incident.
13. Applicable law and disputes
These General Terms and Conditions of Sale are governed by French law.
In case of dispute, the customer is invited to contact KODAWARI FAMILY at hello@boro-denim.com to seek an amicable solution.
For consumer customers, recourse to a consumer mediator may be offered in accordance with applicable rules.
In the absence of an amicable solution, the dispute will be brought before the competent courts in accordance with applicable law.
